The War On Free Speech Continues, Two Students Arrested For Handing Out Constitutions

Kellogg Community College in Battle Creek, Michigan is now being sued by Alliance Defending Freedom, and the campus’ YAL chapter, after two students spent a night in county jail for exercising their freedom of speech.

In September, Brandon Withers and Michelle Gregoire were attempting to recruit for their Young Americans for Liberty chapter by handing out pocket constitutions to their fellow students. The campus administrators decided that by doing this, they were violating the Student Code of Conduct and they were asked to leave the property by campus security.

Even after clarification from the students that they were not forcefully stopping anyone, but merely giving them an opportunity to hear what they have to say, the administrators insisted that they were denying other students the right to get an education.

Chief of Police, Harold West told the activists “Yes we do have civil rights, you have liberties, and you have the First Amendment. However, when they start violating other people’s rights that’s when it starts to run into a problem.”

The confrontation ended when the students decided to take a stand for free speech and refuse to leave the campus. As seen in the video, the officers then proceeded handcuffed them and took them to county jail.

The only rights that were violated in this situation, were the students’ right to speak. 

This is a perfect example of the left’s intolerance and the war that they instigated on free speech. By denying these students the right to say what they wanted, KCC stood against the first amendment right granted to us by the constitution. 

Fortunately, ADF, and YAL will not let this unconstitutional silencing go unnoticed.  

Casey Mattox, ADF Senior Counsel released a statement this Wednesday regarding the incident, “Today’s college students will be tomorrow’s legislators, judges, commissioners, and voters, that’s why it’s so important that public universities model the First Amendment values they are supposed to be teaching to students, and why it should disturb everyone that KCC and many other colleges are communicating to a generation that the Constitution doesn’t matter.”

On the same day, President of Young Americans for Liberty, Cliff Maloney Jr. announced that they would not be backing down and that the YAL chapter of KCC will be filing a lawsuit against the school.

By silencing  opposing viewpoints, colleges are initiating a war on free speech that they will lose, because in the end, freedom and liberty always prevail.

  1. I fail to understand what they could have arrested those students for. After reading the Code of Conduct, the closest possibility might be solicitation or harassment but I think both of those would be reaching.
    Colleges have gotten totally out of control. As a parent, had I the option to make the choice again, I believe I would refuse to send my child to any school espousing these ludicrous liberal ideas.
    I enjoyed reading your post.
